Mark Avery assists his clients with their business, corporate, finance, commercial real estate, wealth preservation and estate planning needs. Nearly all of his work involves business sales, purchases, reorganizations, investments, contracts and operations.
Over more than 19 years, Mark has been involved in the successful completion of over one thousand transactions including: asset, stock and real estate sales and business acquisitions; mergers; recapitalizations; receiverships, start ups; and commercial loans (both domestically and internationally) with values between $100,000.00 and $500,000,000.00. He also has experience in contract negotiation and drafting in Spanish.
He works with investment bankers, business bankers, lenders, buyers and sellers in business sales and purchases in Texas and throughout the country in corporate and business finance relating to buying, selling and recapitalizing business assets, stock and real estate.
His business clients are in such diverse industries as energy, software, finance, securities, IT, manufacturing, real estate development, healthcare, insurance, bioscience, construction, and entertainment.
Mark often speaks to groups about how to buy, sell and operate businesses from a legal perspective while advising on how to lower potential liabilities.
Mark earned his Bachelor of Arts degree in both Spanish and International Business from the University of Idaho, where he was elected to Phi Beta Kappa. He then earned his Juris Doctorate degree from Brigham Young University, where he was elected to Phi Delta Phi and served as a Senior Editor on the Board of Advocates.
At the beginning of his career, Mark worked for two trial judges who took the time to give him special insight into what is most important to a trial court when considering commercial disputes including contract enforcement. He served as a Summer Law Clerk for the Honorable Judge Edward C. Prado of the United States District Court, Western District of Texas, in San Antonio, Texas, and the Honorable Judge Anthony Schofield of the Utah Fourth District Court in Provo, Utah. Mark integrates such insight into the negotiations he conducts and the legal documents he prepares.
Mark is a member of the State Bar of Texas, State Bar of Idaho and the Bar of the District of Columbia. He is active in leadership roles for nonprofit organizations such as the J. Reuben Clark Law Society (promoting ethics in the legal profession), the Austin Management Society (promoting business ethics), the Austin Regional Manufacturers Association (promoting advocacy, networking, and workforce development for manufacturers), the Texas Association of Business Brokers (promoting the interests of MBA advisors and intermediaries), and the church he attends with his family.

Chris joined Hajjar Peters from an international Labor & Employment law boutique and brings a depth of L&E experience and expertise to the firm. Though Chris lives and works in Austin, he grew up in Amarillo and works out of both offices. In addition to his legal skills, Chris also brings his woodturning and woodworking skills to Hajjar Peters and serves as the firm’s Woodworker in Residence.
Labor & Employment Law:
Chris has represented management from small companies to Fortune 50 companies in all manner of employment matters from administrative charges to non-competition agreements to nationwide collective actions. He also regularly advises employers on their employment policies and procedures and helps craft those policies and procedures. He has vast experience handling matters arising under various state and federal labor statutes (including the FLSA, Title VII, EPA, ADA, FMLA, OSHA, ADEA, USERRA, and similar state statutes). Just a few of Chris’ accomplishments are as follows:
Defended a large, publicly-traded retailer in a nationwide collective action brought under the FLSA challenging the overtime exemption for a class of its managers.
Written employee handbooks, HR policies, investigation procedures, and ethics policies for a wide array of businesses with revenues in excess of $1 billion.
Successfully enforced non-compete and non-solicitation agreements resulting in permanent injunctions in favor of the business and the recovery of resulting lost profits.
Federal Litigation and Compliance:
In addition to his experience and expertise in Labor & Employment Law, Chris is a very experienced federal court litigator. Chris has tried jury cases resulting in defense verdicts in every federal district in the State of Texas. He also brings a depth of federal compliance experience related to the banking industry, the trucking and transportation industry, and the construction industry. Just a few of Chris’ accomplishments are as follows:
Represented large publicly-traded and privately-held plaintiff companies in an Antitrust case brought under the Sherman Act for collusion and price-fixing.
Advised and successfully defended companies related to alleged architectural barrier violations brought under Title III of the ADA.
Successfully represented his clients in proceedings and investigations before OSHA and the Department of Labor.
In addition to his legal practice representing clients in an advisory and adversarial setting, Chris is also a Certified Mediator in the State of Texas. He brings a unique perspective to the mediation table based on his having represented both individuals and companies in litigation, having tried a multitude of jury trials, having served as a jury member in a four-week civil trial, and having worked in chambers for two federal judges. Chris uses this unique perspective, along with his keen abilities as a problem-solver and a communicator, to help parties reach a resolution to all kinds of disputes and conflicts.
